Terms of Service for MixAppXpander
Effective Date: May 27, 2026
1. Acceptance of Terms
By downloading, installing, and using MixAppXpander (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. License Grant
MixAppXpander is provided to you under a limited, non-exclusive, non-transferable licence. Your purchase grants you the right to use the App according to the specific plan you have selected:
- One-Time Licence Plans: Grant lifetime use on one device. The licence can be deactivated and moved to another device.
- Subscription Plans: Grant access to all features for the duration of your active subscription, across the specified number of devices.
All rights not expressly granted to you are reserved by MixAppXpander.
3. Restrictions
You agree not to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Rent, lease, lend, sell, redistribute, or sublicense the App or any of its features
- Remove or alter any proprietary notices, labels, or marks on the App
- Use the App to provide services to third parties without written permission
- Share your licence or activation key with others
- Attempt to circumvent or bypass any licence verification mechanisms
4. Intellectual Property
MixAppXpander and all associated content, including logos, design, text, and software, are the exclusive property of MixAppXpander or its licensors. You retain all rights to content you create or process through the App (such as your mixing desk configurations and audio settings).
5. Third-Party Products and Integrations
MixAppXpander is designed to work with Allen & Heath mixing consoles and their official control applications. MixAppXpander is an independent, third-party application and is not affiliated with, approved by, endorsed by, or officially supported by Allen & Heath, Apple, Google, or any other third-party company.
We are not responsible for any issues arising from changes made by third parties to their products, services, or APIs.
6. Licence Activation and Deactivation
To use one-time or subscription-based features, you must activate your licence on a device using a valid activation key. You may:
- Activate your licence on different devices as allowed by your plan
- Deactivate your licence from one device to activate it on another
- Contact support to manage licence activations
Excessive failed activation attempts may temporarily restrict access to licence activation services.
7. Warranty Disclaimer
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MIXAPPXPANDER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free from security vulnerabilities. Use of the App is at your own risk.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIXAPPXPANDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Refund Policy
Refund policies vary depending on where you purchased the App:
- Apple App Store: Subject to Apple's standard refund policy. See Refund Policy for details.
- Paddle: Subject to Paddle's refund policy. See Refund Policy for details.
10. Termination
Your licence to use the App may be terminated immediately without notice if you violate any of these Terms of Service. Upon termination, you must cease all use of the App and any activation keys will be invalidated.
11. Changes to Terms
We may update these Terms of Service at any time. Changes will be effective upon posting. Your continued use of the App after changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
13. Dispute Resolution
Any dispute arising out of or relating to these Terms of Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
